These Terms of Service ("Terms") govern your access to and use of eversteadexteriors.com and any forms, communications, information, referral services, or other services offered by Everstead Exteriors ("Everstead," "we," "us," or "our").
By accessing our website, submitting a form, requesting an inspection or estimate, or otherwise using our services, you agree to these Terms. If you do not agree, please do not use our website or services.
1. ABOUT EVERSTEAD EXTERIORS
Everstead helps homeowners identify exterior property needs, request inspections or estimates, and connect with independent contractors or service providers. Unless expressly stated in a separate written agreement signed by Everstead, Everstead does not perform construction, repair, installation, insurance-adjusting, engineering, legal, or other licensed professional services.
The contractor or service provider that accepts a project is responsible for evaluating the property, determining the scope of work, providing pricing, entering into any project agreement, obtaining required permits, performing the work, providing applicable warranties, and complying with licensing, insurance, safety, and other legal requirements.
2. ELIGIBILITY AND ACCEPTABLE USE
You must be at least 18 years old and legally able to enter into an agreement to use our services. You agree to use our website and services only for lawful purposes.
You may not:
• Submit false, misleading, fraudulent, or unauthorized information
• Submit information about a property you do not own or have authority to represent
• Attempt to disrupt, damage, misuse, or gain unauthorized access to the website or related systems
• Copy, scrape, reproduce, distribute, or commercially exploit website content without written permission
• Use our services in a way that violates another person’s rights or any applicable law
3. INSPECTION AND ESTIMATE REQUESTS
Submitting a form or requesting an inspection, consultation, or estimate does not create a construction contract, guarantee an appointment, or obligate Everstead or any contractor to accept a project.
Inspection findings and estimates may be preliminary and may change after additional investigation, measurements, material selection, discovery of concealed conditions, code requirements, labor availability, or other project-specific factors. Final scope, price, schedule, payment terms, warranties, and responsibilities must be stated in a separate written agreement between you and the contractor performing the work.
You agree to provide accurate information and reasonable access to the property when an inspection or appointment has been scheduled.
4. INDEPENDENT CONTRACTORS AND REFERRALS
Everstead may refer or connect you with independent contractors or other service providers. These businesses are independent from Everstead and are not Everstead employees, agents, partners, joint venturers, or representatives.
Everstead may receive a marketing fee, referral fee, lead fee, commission, or other compensation when it introduces a homeowner to a contractor or when a referred project results in work. This compensation does not increase or change your obligations unless disclosed in your separate agreement with the contractor.
Everstead may review available information when selecting contractors, but we do not guarantee any contractor’s licensing, insurance, qualifications, availability, pricing, workmanship, conduct, financial condition, or continued compliance with legal requirements. Credentials and insurance can expire or change. Before hiring a contractor, you are responsible for reviewing the contractor’s credentials, references, insurance, written agreement, warranties, and other information important to your decision.
Any dispute involving construction work, payment, property damage, delays, warranties, or contractor conduct must be resolved directly with the contractor that provided or agreed to provide the service, except to the extent Everstead separately agreed in writing to be responsible.
5. STORM DAMAGE AND INSURANCE
Everstead is not a public adjuster, insurance company, insurance agent, attorney, engineer, or representative of your insurer. Information provided through our website or communications is general information and is not insurance, legal, engineering, or professional advice.
An inspection or observation of possible storm damage does not guarantee that an insurance claim will be approved or paid. Insurance coverage, claim decisions, deductibles, depreciation, exclusions, and settlement amounts are determined by your insurance policy and insurer.
You are responsible for reviewing your policy, communicating with your insurer, meeting claim deadlines, and obtaining advice from appropriately licensed professionals when needed. You should never intentionally damage property or provide false information in connection with an insurance claim.
6. COMMUNICATIONS
When you provide contact information, you authorize Everstead to contact you regarding your inquiry, requested inspection, estimate, appointment, referral, or related services by telephone, email, or text message, subject to applicable law and the consent language shown when you submit your information.
For text messages, message frequency varies and message and data rates may apply. Consent to receive marketing text messages is not a condition of purchasing goods or services. You may opt out of text messages by replying STOP. For assistance, reply HELP or email info@eversteadexteriors.com. You may unsubscribe from marketing emails by using the unsubscribe link in the email.
7. PRICING, PAYMENTS, AND PROJECT AGREEMENTS
Unless Everstead expressly enters into a separate written agreement with you, all project pricing, deposits, financing, payment schedules, change orders, cancellations, refunds, warranties, and collection matters are determined by your agreement with the contractor performing the work.
Do not rely on oral statements that conflict with a written project agreement. Carefully review all documents before signing or making a payment. Everstead is not responsible for funds paid directly to an independent contractor.
8. WEBSITE INFORMATION
We try to keep information accurate and current, but website content is provided for general informational purposes. Exterior conditions, product availability, building codes, manufacturer requirements, prices, timelines, insurance practices, and contractor availability may change.
We do not guarantee that website information is complete, current, error-free, or appropriate for a particular property. Website content is not a substitute for an on-site evaluation or advice from a qualified professional.
9. PHOTOGRAPHS AND MATERIALS YOU SUBMIT
You retain ownership of photographs and other materials you submit. You grant Everstead a nonexclusive, royalty-free license to store, reproduce, and share those materials as reasonably necessary to evaluate your request, communicate with you, connect you with a contractor, provide requested services, maintain business records, and comply with law.
You represent that you have the right to submit those materials and that our permitted use of them will not violate another person’s rights. We will not use identifiable photographs of your home for public marketing without permission, except where the image has been lawfully obtained from another source or sufficiently de-identified.
10. INTELLECTUAL PROPERTY
The Everstead name, logo, website design, text, graphics, and other original website content are owned by or licensed to Everstead and are protected by applicable intellectual-property laws. You may view and print website content for personal, noncommercial use. No other use is permitted without prior written authorization.
11. THIRD-PARTY WEBSITES AND SERVICES
Our website may link to or integrate with third-party websites, platforms, contractors, financing providers, manufacturers, or other services. Everstead does not control and is not responsible for their content, availability, security, products, services, terms, or privacy practices. Your use of a third-party service is governed by that third party’s agreements.
12. PRIVACY
Our collection and use of personal information are described in our Privacy Policy, available at eversteadexteriors.com/privacy-policy. The Privacy Policy is incorporated into these Terms by reference.
13. DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE, CONTENT, REFERRAL SERVICES, AND OTHER SERVICES PROVIDED BY EVERSTEAD ARE OFFERED “AS IS” AND “AS AVAILABLE.” EVERSTEAD DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
EVERSTEAD DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT USING OUR SERVICES WILL RESULT IN A PARTICULAR CONTRACTOR, PRICE, PROJECT OUTCOME, INSURANCE DECISION, OR OTHER RESULT.
Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
14. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, EVERSTEAD AND ITS OWNERS, EMPLOYEES, REPRESENTATIVES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST OPPORTUNITIES, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO YOUR USE OF THE WEBSITE OR SERVICES.
UNLESS A DIFFERENT AMOUNT IS REQUIRED BY LAW, EVERSTEAD’S TOTAL LIABILITY FOR A CLAIM ARISING FROM THE WEBSITE OR REFERRAL SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO EVERSTEAD FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE SIX MONTHS BEFORE THE CLAIM OR (B) $100.
Everstead is not liable for the acts, omissions, statements, estimates, agreements, delays, workmanship, safety practices, property damage, payment disputes, warranties, or other conduct of an independent contractor or third-party provider.
Nothing in these Terms excludes liability that cannot legally be excluded or limited.
15. INDEMNIFICATION
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Everstead and its owners, employees, and representatives from claims, damages, liabilities, losses, and reasonable costs arising from your unlawful or unauthorized use of the website, information or materials you submit, your violation of these Terms, or your violation of another person’s rights.
16. TERMINATION
We may suspend or terminate access to our website or services if we reasonably believe you violated these Terms, misused our services, created risk or potential legal exposure, or engaged in fraudulent, abusive, or unlawful conduct. Provisions that by their nature should survive termination will remain in effect.
17. GOVERNING LAW AND VENUE
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Subject to any rights you may have under applicable consumer law, legal proceedings arising from these Terms or Everstead’s services must be brought in a state or federal court with jurisdiction in St. Louis County or St. Charles County, Missouri, as applicable.
Before filing a lawsuit, you and Everstead agree to make a good-faith effort to resolve the dispute informally by providing written notice describing the issue and requested resolution. This requirement does not prevent either party from seeking urgent injunctive relief or filing a claim before an applicable limitations period expires.
18. CHANGES TO THESE TERMS
We may update these Terms periodically. Updated Terms will be posted on this page with a revised “Last updated” date. Changes apply prospectively when posted. Your continued use of the website or services after an update constitutes acceptance of the revised Terms.
19. GENERAL PROVISIONS
These Terms and the Privacy Policy constitute the agreement between you and Everstead regarding the website and referral services, except for any separate written agreement that expressly applies. If a provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our written consent. We may assign these Terms in connection with a reorganization, sale, or transfer of our business.
